These Terms of Use (“Terms”) are a legal agreement between you and James Prigioni Productions LLC d/b/a Team Grow (“Team Grow,” “we,” “us,” or “our”) governing your access to and use of the Team Grow mobile application, website, content, products, tools, features, and related services (collectively, the “Services”).
If you download or use the Team Grow iOS app, these Terms also serve as the end user license agreement for the app.
By downloading, accessing, or using the Services, you agree to these Terms. If you do not agree, do not use the Services.

2. Eligibility
You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Services on your own. If you are under that age, you may use the Services only with the involvement and consent of a parent or legal guardian.
By using the Services, you represent and warrant that you have the legal capacity to enter into these Terms.
3. Scope of License
Subject to these Terms, Team Grow grants you a limited, non-exclusive, non-transferable, revocable license to download, install, access, and use the app and Services for your personal, non-commercial use on devices you own or control, and as otherwise permitted by applicable platform usage rules.
This license does not transfer any ownership rights to you. All rights not expressly granted are reserved by Team Grow and its licensors.
4. Acceptable Use
You agree that you will not:
use the Services for any unlawful, harmful, fraudulent, or abusive purpose;
copy, reproduce, distribute, modify, adapt, translate, reverse engineer, decompile, or disassemble any part of the Services except as expressly permitted by law;
interfere with or disrupt the Services, servers, or networks;
attempt to gain unauthorized access to accounts, systems, or data;
upload or transmit malicious code, viruses, or harmful material;
scrape, harvest, or collect data from the Services without our permission;
impersonate another person or misrepresent your identity;
use the Services in a way that infringes any third-party rights.
We may suspend or terminate access to the Services if we believe you have violated these Terms.
5. Accounts
Some features may require you to create an account. You agree to provide accurate, current, and complete information and to keep it updated.
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. If you believe your account has been compromised, contact us promptly at hello@teamgrow.us.
6. User Content
The Services may allow you to submit, upload, post, record, transmit, or otherwise make available content, including text, photos, videos, audio, comments, reviews, garden information, and other materials (“User Content”).
You retain ownership of your User Content. By submitting User Content, you grant Team Grow a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify, adapt, publish, display, perform, distribute, and use that User Content as needed to operate, improve, market, and provide the Services.
You represent and warrant that:
you own or control the rights necessary to submit the User Content;
your User Content does not violate any law or infringe any third-party rights;
your User Content is not fraudulent, defamatory, obscene, harassing, or otherwise objectionable.
We may remove or disable User Content at our discretion.
7. Community Standards
If the Services include community, educational, or social features, you agree not to post or share content that:
is abusive, threatening, hateful, or discriminatory;
contains spam, scams, or misleading claims;
promotes illegal conduct or unsafe activity;
violates another person’s privacy or intellectual property rights.
We may moderate content, but we are not obligated to monitor all user activity or content.
8. Purchases, Subscriptions, and Paid Features
The Services may offer paid products, services, subscriptions, bookings, consultations, digital content, or in-app purchases.
If you make a purchase, you agree to pay all applicable charges, taxes, and fees. Prices and availability may change at any time.
If you purchase a subscription, your subscription may automatically renew unless canceled before the renewal date. For purchases made through Apple’s App Store, billing, renewal, and cancellation may be handled by Apple through your Apple account settings. For purchases made through other channels, the terms of the applicable payment provider may apply.
Except where required by law or expressly stated otherwise, fees are non-refundable.
9. Third-Party Products and Services
The Services may feature, link to, or facilitate access to third-party products, services, content, websites, installers, growers, educators, merchants, or other providers.
Team Grow does not own or control third-party providers and is not responsible for their actions, content, quality, availability, safety, legality, or terms. Your dealings with third parties are solely between you and the third party, unless otherwise expressly stated.
10. Educational Content and Gardening Disclaimer
The Services may provide gardening, growing, planning, planting, pruning, harvesting, installation, or general educational content. This content is provided for general informational purposes only.
Team Grow does not guarantee specific gardening outcomes, crop yields, plant health, pest control success, construction results, or any other results. Growing conditions vary by region, climate, soil, season, tools, materials, experience, and other factors outside our control.
You are solely responsible for how you apply any information obtained through the Services. Always use appropriate judgment and safety precautions, and consult qualified professionals where appropriate, including for structural, electrical, plumbing, pesticide, zoning, food safety, or other specialized matters.
11. Intellectual Property
The Services, including the app, design, text, graphics, logos, videos, audio, software, trademarks, and other content provided by Team Grow, are owned by or licensed to Team Grow and are protected by intellectual property and other laws.
You may not use Team Grow’s name, logos, branding, or content except as expressly permitted by these Terms or with our prior written consent.
12. Privacy
Your use of the Services is also governed by our Privacy Policy, available at:

By using the Services, you acknowledge that we may collect, use, and share information as described in the Privacy Policy.
13. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we believe you have violated these Terms, created risk for us or others, or if we discontinue the Services.
You may stop using the Services at any time. Upon termination, the rights granted to you under these Terms will immediately end.
14. Disclaimer of Warranties
To the maximum extent permitted by law, the Services are provided “as is” and “as available,” without warranties of any kind, whether express, implied, statutory, or otherwise.
Team Grow disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, and quiet enjoyment.
We do not warrant that the Services will be uninterrupted, error-free, secure, or free of harmful components, or that any content will be accurate, complete, or reliable.
15. Limitation of Liability
To the maximum extent permitted by law, Team Grow and its affiliates, officers, directors, employees, contractors, licensors, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, business opportunity, crops, garden results, or other intangible losses arising out of or related to your use of or inability to use the Services.
To the maximum extent permitted by law, Team Grow’s total liability for any claim arising out of or relating to the Services or these Terms will not exceed the greater of:
(a) the amount you paid to Team Grow for the Services in the 12 months before the event giving rise to the claim; or (b) USD $100.
Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
16. Indemnification
You agree to defend, indemnify, and hold harmless Team Grow and its affiliates, officers, directors, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
your use of the Services;
your User Content;
your violation of these Terms; or
your violation of any law or third-party right.
17. Governing Law
These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.
To the extent permitted by law, any dispute arising out of or relating to these Terms or the Services shall be brought exclusively in the state or federal courts located in New Jersey, and you consent to the personal jurisdiction of those courts.
If applicable law in your jurisdiction gives you the right to bring claims elsewhere, this section will apply only to the extent permitted by law.
18. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice through the app, website, email, or other reasonable means. The updated Terms will become effective as of the date posted.
Your continued use of the Services after the updated Terms take effect means you accept the revised Terms.
19. Apple-Specific Terms for iOS Users
This Section applies only if you access or use the Team Grow app on an Apple device.
These Terms are between you and James Prigioni Productions LLC, not with Apple, and Team Grow, not Apple, is solely responsible for the app and its content.
Apple has no obligation whatsoever to furnish any maintenance or support services for the app.
To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the app. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, for the app. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever with respect to the app.
Team Grow, not Apple, is responsible for addressing any claims by you or any third party relating to the app or your possession and use of the app, including:
product liability claims;
any claim that the app fails to conform to any applicable legal or regulatory requirement; and
claims arising under consumer protection, privacy, or similar laws.
If any third party claims that the app or your possession and use of the app infringes that third party’s intellectual property rights, Team Grow, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of that claim.
You represent and warrant that:
you are not located in a country or region subject to a U.S. government embargo or designated as supporting terrorism; and
you are not listed on any U.S. government list of prohibited or restricted parties.
You must comply with all applicable third-party terms when using the app.
Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will.
